By using North America Telco’s services you agree to the following Terms of Service. These Terms of Service may be modified without notice.
Use of North America Telco services
You may use North America Telco services provided that you are of legal age to form a binding contract and are not a person barred from receiving services under the laws of the United States or other applicable jurisdiction
Charges and billing
All payments for service must be made via PayPal or accepted Credit/Debit card. You must ensure that you are able to make payment via PayPal or accepted Credit/Debit card before agreeing to use the services of North America Telco.
Backups and Data loss
While North America Telco will make every effort to ensure the consistency of your data and backups, your use of North America Telco services is at your sole risk. North America Telco is not responsible for files and/or data residing on our servers.
You must ensure that you have approved access to the systems that you employ North America Telco to work on. You agree that North America Telco may access your servers to complete any agreed work
Limitation of liability
YOU EXPRESSLY UNDERSTAND AND AGREE THAT North America Telco SHALL NOT BE LIABLE TO YOU FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO, DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA OR OTHER INTANGIBLE LOSSES.
YOU AGREE THAT YOUR USE OF North America Telco SERVICES SHALL BE AT YOUR SOLE RISK. ALL SERVICES PROVIDED BY North America Telco ARE AVAILABLE AS IS WITHOUT WARRANTIES OR GUARANTESS APPLIED.
Refunds are only given when both yourself and North America Telco agree that the service provided does not meet expected standards
If you wish to cancel any recurring service from North America Telco you must use the contact form on this web site to advise us of your request. Cancellation requests must be made before that months payments are made.
Payments must be made within 3 days of the due date. Payments not made within 3 days of the due date will result in the service being suspended
If a customer paying by PayPal subscription cancels his or her subscription without informing North America Telco, it will be assumed a notice of termination and the VPS or server will be cancelled at the end of the current billing period
Any payments not made within 7 days of the due date will result in the service being terminated and all data being deleted
Products and services will be billed in US dollar
All payments must be by PayPal funds or accepted Credit/Debit card via PayPal.
Money Back Guarantee
If you are not satisfied for any reason after within 14 days of your VPS or server being provisioned you are eligible for a full refund of your first months payment. You must request cancellation and a refund within 14 days by submitting a ticket via the helpdesk system to use this guarantee.
Cancellation requests should be made by submitting a ticket or cancellation request in the helpdesk system
VPS or servers are unmanaged. North America Telco will be responsible for ensuring the underlying hardware and network is available, the customer will be responsible for configuring and maintaining their VPS or server. North America Telco will advise and assist in the initial configuration of FreePBX and A2Billing where possible.
Customers are responsible for ensuring their systems are configured securely. North America Telco shall not be liable for any loss resulting from the VPS or server being compromised by a third party.
If your server is attacked (DDoS) then we reserve the right to disable your VPS or server without notice.
While every effort will be made to protect your data you are responsible for ensuring that any data stored on our VPS or servers is backed up.
